1. Acceptance of terms
By accessing the content of 10th Legion Fightwear (“the Website”) you agree to be bound by the terms and conditions set out herein and you accept our privacy policy. If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately. You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information. You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.
By ordering a product/products from 10th Legion Fightwear tthe Customer agrees that they are accepting these terms & conditions. All orders for products and services on The Strength Company website are subject to these terms and conditions of sale. No other terms will apply to the supply of products and services by The Strength Company unless agreed in writing by an authorized signatory of 10th Legion Fightwear. 10th Legion Fightwear is an Internet based retail business and as such communication between 10th Legion Fightwear and the Customer is by e-mail. The Customer agrees that email is a suitable form of communication regarding their orders, and that the Customer has access to an email account.
2. Products and Availability Information
10th Legion Fightwear may correct any errors on its website without liability to the Customer. The advertising of products and services on 10th Legion Fightwear website merely constitutes an invitation by 10th Legion Fightwear for the Customer to make an offer to purchase products and services. Notwithstanding the foregoing, nothing in these terms and conditions of sale shall affect the statutory rights of a Customer.10th Legion Fightwear eserves the right, without prior notice, to discontinue any product or to make design changes as part of its continuous program of product improvement, or to assist product availability, and such changes may take place during the life of 10th Legion Fightwear website.
3. Ordering
10th Legion FIghtwear reserves the right to decline to trade with any organization or individual. In addition, 10th Legion Fightwear may decline to accept any order, whether or not payment has been received, by giving notice of non-acceptance to the Customer by email within a reasonable period of receipt by 10th Legion Fightwear of the order. 10th LegionFightwear executes orders to the Customer's requirements, and does not substitute one product for another unless requested by the Customer, or unless the product has been superseded by the latest version. To the extent that orders cannot be fulfilled completely from stock, the unfulfilled balance will (at the Customer's option) either be put on back order to be fulfilled when 10th Legion Fightwear next has available stock or be canceled.
This website should only be used for ordering purposes by persons over the age of eighteen (18).
4. Price & Payment
The prices of the products and services as set out in 10th Legion Fightwear website are current at the date of dispatch. All prices include VAT. 10th Legion Fightwear reserves the right to change prices without prior notice at any time. Postage and packing will be added as a flat rate to each individual order purchased. Where possible 10th Legion Fightwear will ship item(s) together however larger items or multiple quantity orders may require multiple parcels which will be charged pro-rata.
4.1 Methods of payment
Payments for goods bought from 10th Legion Fightwear, is also taken via PayPal one of the worlds leading Internet payment systems. By using PayPal the Customer is able to shop on-line safe in the knowledge that they are buying from 10th Legion Fightwear without sharing their financial information. The Strength Company does not get to see any of the Customer’s credit/debit card details or any personal financial information. The Customer accepts responsibility to ensure that the credit/debit card that the Customer uses for payment is the Customer’s own, that the details that the Customer supplies to The Strength Company are correct, and that they have sufficient funds to cover the cost of goods ordered.
5. Delivery and Shipping
Mainland UK
10th Legion Fightwear will attempt dispatch the Customer’s order within 48 hours from the date that the order was placed (working days only, which exclude Saturday, Sunday and UK Bank Holidays) with an expected arrival time of between 2-5 days. The Customer should allow up to 14 days in consideration of unforeseen circumstance. 10th Legion Fightwear uses an outsourced courier service for the delivery of products, and while every effort will be made to adhere to delivery requests, 10th Legion FIghtwear will not accept any claim for compensation arising from late or missed delivery.
Europe and rest of world
Delivery costs stated on 10th Legion Fightwear website are for orders placed in Mainland UK - delivery to outside of the Mainland UK is possible at additional cost. 10th Legion Fightwear is able to ship most of the products featured on this site anywhere in the World. Prices vary by product and shipping destination. For any queries regarding delivery, please email info@10thlegionfightwear.com
Please note - any customer, who refuses to accept delivery of their order for any reason other than the product being damaged in transit, will be subject to a 15% re-stocking fee. In addition, the customer will be liable for any delivery costs incurred by 10th Legion Fightwear.
6. Back orders
If an ordered item is not in stock, 10th Legion Fightwear will back order it. The Customer will be contacted with the option to cancel their order if they would rather not wait.
7. Exchanges or Returns
Customers have the right to withdraw from the purchase of an order within a seven (7) working days ‘cooling off period’ after the delivery of the item. Items must be returned to The Strength Company at the customers expense in their original packaging and in perfect ‘saleable’ order – The Strength Company reserves the right to withhold a percentage of the refund value of returned goods if the product or packaging is in such a condition that the item needs to be reduced in price for resale.
In order to arrange a refund or exchange, you require a Returns Authorization Number from a member of 10th Leion Fightwear staff. To obtain this, simply email sales@10thleionfightear.com and you will receive a reply with a Returns Authorization Number (that you will need to quote on all subsequent correspondence). We will review and where appropriate, authorize your query and provide instructions on how to proceed with the product return. Returns will only be accepted with a valid Returns Authorization Number and prior approval from The Strength Company. Any promotional items received when purchasing the goods that are to be returned, must also be returned or paid for in full. We recommend using a registered service when returning any items to us. All returns are subject to an additional restocking fee of 5% of the original retail price.
8. Cancellation
By law, customers in the UK have the statuary right under the Consumer Protection (Distance Selling) Regulations 2000 to cancel their order (prior to shipment) for any item purchased on 10th Legion Fightwear website for a full refund. Customers may cancel their order and receive a full refund prior at any time before the order has been shipped. However should a customer wish to cancel their order after it has been dispatched, the customer is liable for any delivery costs incurred by 10th Legion Fightwear, this excludes any 'custom made' or 'bespoke' equipment.
The regulations require the customer to send a notice of cancellation in writing or email. For cancellations prior to dispatch, please send an email to sales@10thlegionfightwear.com
9. Warranty
All products Strength Compnay sold on our website are covered by a full manufacturers’ warranty. Warranties vary from manufacturer to manufacturer as well as by product. Customers should refer to the product specific user manual or speak to a member of the sales team for details of individual product warranties. 10th Legion Fightwear warrants that if any product purchased from the Website is defective, it will replace the product or refund the purchase price. These warranties shall not apply to any defect, which arises from improper use, failure to follow the product instructions, or any repair or modification made without the consent of 10th Legion Fightwear. The Customer must return the products, or make them available for collection by 10th Legion Fightwear, in accordance with The Strength Company’s instructions. If returned they must be suitably packaged and, where relevant, returned in accordance with any particular instructions, which 10th Legion Fightwear may have notified to the Customer at the time of supply. The Customer must contact 10th Legion Fightwear to notify 10th Legion FIghtwear of their return and obtain a Return Authorization Number, which is to be quoted on all paperwork. Returned products must be accompanied by an advice note stating the original invoice number in respect of the products and the nature of any claimed defect, together with such further information as 10th Legion Fightwear may at the time of supply have stipulated. Where the Customer returns products otherwise than in accordance with these warranty provisions, 10th Legion Fightwear may refuse such products and return them to the Customer at the cost of the Customer. Any products, which are replaced by 10th Legion Fightwear, shall become the property of 10th Legion Fightwear. Title to replacement products shall pass to the Customer on delivery, and the period of the replacement product's warranty shall be calculated from the date of dispatch of the defective product. The remedies set out above shall be 10th Legion fightwear’s sole liability and the Customer's sole remedy for any breach of warranty. Save as expressly provided in these terms and conditions of sale, all implied warranties, terms and conditions (whether statutory or otherwise) are excluded to the fullest extent permitted by law. The 10th Legion Fightwear will not be liable to the Customer for any loss of any kind whatsoever which arises out of the breach of implied warranties, terms or conditions (statutory or otherwise) or breach of any other duty of any kind imposed on 10th Legion Fightwear by operation of law. The Customer acknowledges that it is responsible for ensuring that the products and services it orders are fit for the purposes for which it intends to use them.
10. Liability
10th Legion Fightwear accepts no responsibility for any omissions or errors, and we reserve the right to change any or all information that relates to listing products or services. The Strength Company will endeavor to update outdated or incorrect information relating to any products or services as quickly as possible. The goods sold on this website are intended for private and domestic consumer use only. 10th Legion Fightwear accepts no responsibility for any direct or indirect loss of data, income or damage to property resulting in the use of this website or any products purchased from it. 10th Legion Fightwear, to the fullest extent of the law, is providing this website and all of its contents on a purely 'as is' basis. It is an illegal act to purchase goods using a false name or a known invalid credit/debit card. Any individual, group, association or company that is found to willingly enter false details to their order information may be subject to prosecution under the full extent of the law. 10th Legion Fightwear reserves the right to update or amend these Terms and Conditions at any time they so wish. All purchases made will come under the Terms and Conditions that were applicable at the time the order is placed. It is the customer’s responsibility to check the Terms and Conditions prior to the placement of each order to ensure that the Customer agrees to any amendments that have been made prior to placing an order. 10th Legion Fightwear shall not be under any liability for damage, loss or expenses resulting from the failure to give advice or information or the giving of incorrect advice or information whether or not due to its negligence or that of its employees, agents or sub-contractors. 10th Legion Fightwear accepts no liability for injuries of any type. 10th Legion Fightwear shall not be liable for intellectual property rights infringement, punitive damages, loss of revenue, loss of profits or expected future business, damage to reputation or goodwill, loss of any order or contract or any consequential or indirect loss or damage, all as may result from, or be connected with: (i) any express or implied terms of the contract between 10th Legion Fightwear and the Customer, or of any order accepted by 10th Legion Fightwear; (ii) any duty of any kind imposed on 10th Legion Fightwear by law arising out of or in relation to the contract or order; or (iii) any defect in the products or services.
11. Force Majeure
A force majeure event is any event beyond the reasonable control of 10th Legion Fightwear (including strikes, traffic congestion, the downtime of any external line, or 10th Legion Fightwear's inability to procure services, materials or articles required for the performance of the contract except at enhanced prices). If 10th Legion Fightwear is prevented or restricted from carrying out all or any of its obligations under these terms and conditions of sale by reason of any force majeure event, then 10th Legion Fightwear shall be relieved of its obligations during the period that such event continues, and shall not be liable for any delay and/or failure in the performance of its obligations during such period. If the force majeure event continues for a period longer than fourteen (14) days, 10th Legion Fightwear cancel the affected order or cancel the whole or any part of these terms and conditions of sale, without any liability to the Customer.
12. Rights In The Website
The Customer acknowledges that 10th Legion Fightwear and its licensors own the intellectual property rights in 10th Legion FIghtwear website, the website content, copy, photos and the stock numbers, and that their whole or partial reproduction without The Strength Company’s prior written consent is prohibited.
13. Copyright
All intellectual property of 10th Legion Fightwear such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of 10th Legion Fightwear. The contract between 10th Legion Fightwear and the Customer shall be governed by and interpreted in accordance with English Law and the Customer submits to the jurisdiction of the High Court of Justice in England, but 10th Legion Fightwear may enforce the contract in any court of competent jurisdiction.
